On November 5th, 2025, the National Agency for Industrial Safety and Environmental Protection of the Hydrocarbons Sector (Agencia Nacional de Seguridad Industrial y de Protección al Medio Ambiente del Sector Hidrocarburos “ASEA”) published in the Official Gazette of the Federation the “Agreement establishing simplification actions for procedures carried out before the National Agency for Industrial Safety and Environmental Protection of the Hydrocarbons Sector, as well as the issuance and modification of the formats referred to in said Agreement” (the “Agreement”). The full text can be consulted here.
- Seven procedures with similar characteristics were reviewed and grouped into three, to reduce duplication, facilitate management, delete certain requirements, and standardize submission formats.
- New formats were issued (Annexes 1, 2, 3, and 4 of the Agreement), which merge or replace the existing ones, with the purpose of generating a single format for similar procedures:
- Annex 1: Form FF-ASEA-023 corresponding to the application and update of the operating license for service stations for the retail sale of petroleum products (gasoline and/or diesel), liquefied petroleum gas, natural gas, and simultaneous public sale (including multimodal service stations).
- Annex 2: Form FF-ASEA-022 corresponding to the application for the licencia única Ambiental (single environmental licence) for hydrocarbon sector activities.
- Annex 3: Form FF-ASEA-062 for the submission of notices and/or opinions regarding Mexican Official Standards (Normas Oficiales Mexicanas).
- Annex 4: Form FF-ASEA-061 to submit information for the control and monitoring of air pollutant emissions at service stations for the retail sale of gasoline and/or diesel, corresponding to procedure ASEA-2025-005-011-A.
I. Content of the Agreement
ASEA aims to simplify and merge various procedures carried out before the agency, to reduce administrative burdens, eliminate requirements, and shorten resolution periods:
- Regarding the operating license for service stations for the retail sale of petroleum products (gasoline and/or diesel), liquefied petroleum gas, natural gas, and simultaneous public sale (including multimodal service stations), the procedures for authorization and updating were merged, and the requirement to submit a site layout was eliminated.
- Concerning the single environmental license for hydrocarbon sector activities, ASEA modified the format by removing data and requirements such as: indicating whether the regulated party holds additional environmental impact authorizations, providing employee information, and submitting the site layout. In addition, the maximum resolution period was reduced from 96 to 70 calendar days.
- Procedures related to operation notices and compliance reports (pre-startup, start of operations, operation, and maintenance) have been integrated under the new procedure identified as ASEA-2025-005-006-A, into a single format that allows selection of the type of notice or report being submitted, thereby eliminating multiple forms. It should be noted that the requirements remain the same, except that they are now consolidated in a single format.
- The structure of Form FF-ASEA-061 for document submission was modified, specifically regarding the section for entering installation data.
- The submission of information for the control and monitoring of air pollutant emissions at service stations for the retail sale of gasoline and/or diesel, corresponding to procedure ASEA-2025-005-011-A, will now be carried out using the updated Form FF-ASEA-061, in accordance with the Agreement.
It is important to highlight that no new requirements were added to any of the procedures, only the corresponding formats were modified.
A table specifying the modifications to the procedures is attached as an annex to this document.
II. Transitory Provisions
According to the First Transitory Provision, the Agreement will enter into force the day after its publication in the Official Gazette of the Federation; that is, on November 6th, 2025. It is therefore recommended to keep in mind to avoid submitting procedures using outdated formats.
The Second Transitory Provision specifies that procedures submitted prior to the entry into force of the Agreement will not be subject to its provisions and will be resolved in accordance with the regulations in effect at the time of their submission.
Finally, the Third Transitory Provision stipulates that ASEA will update the information regarding its procedure files on the Single Citizen Portal for Procedures and Services (Portal Ciudadano Único de Trámites y Servicios).
