Recent amendments were made to the Mexico City Tourism Law and its Regulations in line with various changes introduced in April 2024.
The key aspect of these amendments is the intention to restrict property owners or holders leasing their properties through digital platforms such as Airbnb, Expedia, and Booking.com, among others.
The changes limit occupancy to a maximum of 50% of the total nights available per year. If this limit is exceeded, the owners will lose the right to renew their authorization to offer accommodation services through these platforms for the following year.
Additionally, several new obligations have been introduced. These include requirements to purchase civil liability insurance and restrictions on the number of rentable rooms: no more than five (5) rooms for houses or duplexes and a maximum of four (4) rooms for flats. These measures aim to promote fair competition with the hotel industry, although such restrictions appear disproportionate and unjustified.
We believe that these amendments are overly restrictive and infringe on various rights. As such, we recommend considering legal action through an indirect constitutional trial (juicio de amparo indirecto) to challenge these changes.
